Job Details

Position Overview:
We are seeking a dedicated and experienced Special Education Litigation Attorney to join our legal team. This role involves representing clients in complex special education matters, advocating for students' rights, and ensuring compliance with both federal and state education laws. The ideal candidate will be well-versed in special education law, possess excellent litigation skills, and be passionate about advancing the rights of students with disabilities.

Key Responsibilities:

Case Management:
- Manage a diverse caseload of special education disputes including Individualized Education Program (IEP) violations, procedural due process hearings, and related litigation.
- Develop case strategies, draft legal documents, and prepare for mediation, hearings, and trial.
Client Advocacy:
- Represent students, families, and educational institutions in negotiations and litigation.
- Provide legal advice regarding the rights of students under the Individuals with Disabilities Education Act (IDEA) and related statutes.
Legal Research and Analysis:
- Conduct comprehensive legal research to support case strategy and ensure the most current and effective legal arguments.
- Analyze and interpret federal, state, and local special education laws and regulations.
Collaboration and Communication:
- Work closely with school districts, advocacy groups, and other stakeholders to resolve disputes amicably.
- Maintain open lines of communication with clients, keeping them informed about case developments.
Compliance and Ethics:
- Ensure all legal actions comply with ethical standards and applicable laws.
- Stay updated on legislative changes affecting special education law.

Qualifications:
  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the Pennsylvania Bar and in good standing.
  • A minimum of 3 years' experience in litigation with a focus on special education law.
  • Demonstrated success in handling special education disputes, including experience with IDEA-related cases.
  • Excellent legal research, writing, and oral advocacy skills.
  • Strong interpersonal skills with the ability to work collaboratively and build relationships with diverse stakeholders.
  • Commitment to advancing the rights and educational opportunities for students with disabilities.

Preferred Skills and Experience:
  • Experience in mediation and alternative dispute resolution techniques.
  • Familiarity with local education policies and administrative procedures.
  • Ability to work independently and manage multiple cases simultaneously.
  • Proficiency with legal research tools and case management software.
