Work Unit Overview: The Adjudication Program administers the Montana Water Use Act under Title 85, Chapter 2, Montana Codes Annotated. This act provides for adjudicating Montana's existing or pre- 1973 water rights (the adjudication Program), acquiring new water rights and changing existing water rights (the New Appropriations Program within the Water Rights Bureau); and a central ized water right record system. The Adjudication Program provides technical and administrative assistance to the Water Court, is responsible for formulating rules and policy to address the examination of existing water rights, and provides work planning, support and oversight to the Division's eight regional offices and the three work units in Helena. The Adjudication Program provides technical information to the Montana Water Court in the statewide adjudication of all pre-July 1, 1973, water rights. Staff analyze statements of claim filed in the adjudication process, water right records, and other data sources to identify legal and factual issues, perform aerial photographs and regional analyses, interview claimants, synthesize this data, and report findings to the Water Court. As decrees are issued, staff evaluate and prepare comments regarding potential DNRC objections. Staff also perform investigations, give testimony in water rights cases, and provide assistance to the Water Court in collecting, checking, processing, recording, and maintaining water right claims, evidence, records, and case documents. Program staff provide assistance and information to other agencies and the public regarding state water use laws, water availability, and local water use patterns. The program also provides information and support for the state water rights records system. Job Overview: This position is responsible for oversight and quality control of the DNRC's Adjudication Program. Duties include statewide program direction and monitoring; develops and conducts training for bureau and regional staff, set priorities and performance measures, evaluates performance and quality of work, distributes policies, and performs a variety of duties related to the efficient operation of the Adjudication Program in meeting the goals of the bureau. The position reports to the Adjudication Program Manager. The Program Quality Control Coordinator oversees the quality of work of Adjudication Program staff including the staff in the regional offices. The Program Quality Control Coordinator has the responsibility of resolving problems of detail, establishing a statewide quality control process, in addition to reviewing work products for accuracy, adequacy and timeliness, and recommending training. Also collaborates with the Adjudication Program Manager with work planning for the bureau and regional offices. Essential Functions (Major Duties or Responsibilities): These job functions are the essential duties of the position and are not all-inclusive of all the duties that may be assigned to the incumbent. Quality Control: Provide technical assistance, training and information to regional staff, Water Resource Supervisors, Regional office managers and bureau chief regarding regional office operating standards, program policies and procedures, legal issues, technical processes including GIS mapping and water right database application, data interpretation, and administrative practices and their application in various circumstances. Ensuring policy is followed in a consistent and equitable manner across the state. This work requires an in-depth knowledge of program policies and legal requirements, and skill in communicating a variety of technical and legal issues in terms understandable to a wide range of audiences. Monitor and Coordinate Work Progress: Monitor the quality of work of the regional offices to ensure adherence to statute and guidance are met. Set performance measures and evaluate work performance of the program staff. Resolve problems and disputes that may arise in the coordination of the work progress. This work requires knowledge of the principles and practices of public administration and natural resource regulation; program goals and objectives regarding general water right program statutes, rules and policies; examination methodologies, GIS and database technologies, procedures, and comparison standards; Montana water law as contained in historical court orders, case law, and Attorney General Opinions; and skill and ability in compiling and synthesizing information, organizing workloads, and communicating effectively both verbally and in writing. Other Duties as Assigned: Perform a variety of special projects, including conducting administrative hearings, attending training courses and continuing education, and representing the programs at conferences, meetings, and other events as assigned by the bureau chief. This involves tasks such as assisting in budgeting and bureau planning activities, assuming aspects of bureau management responsibilities in the chief's absence, assisting in the development and testing of computer programs. Minimum Qualifications (Education and Experience): Bachelor's degree in business or related field such as environmental sciences, natural resource management, or related field. Three years' (four preferred) experience in water resource administration including water rights, teaching, database structure, development, analysis and testing, program evaluation, and policy development. Other combinations of education or experience may be substituted. Preferred knowledge: Knowledge of the principles and practices of natural resource management and program administration. Knowledge of Montana adjudication process. Knowledge of Montana Supreme Court water rights claim examination rules, the Water Rights examination manual, and court orders, examination methodologies, procedures, and comparison standards. Knowledge of the New Appropriation Program; the records program for document storage and retrieval; program goals and objectives; GIS technology; water right data base; Montana water law as contained in the historical court orders, case law, and Attorney General Opinions; irrigation and water management practices, methods, and design; water use practices in Montana such as domestic, stock, mining, municipal, commercial, and hydropower; Knowledge of personal and mainframe computers and program software applications. The position also requires a practical knowledge of accounting, teaching, administrative practices, and personnel and supervisory practices. Special Information: Candidates must be eligible to work in the United States. A valid driver's license is required with less than 12 conviction points in the most recently complete 36 months.
