Summary/Objective

Responsible for ensuring a company's policies and procedures comply with regulatory and ethical standards. The position will direct all compliance and quality assurance-related activities, including the development and monitoring of a work plan that describes all QA activities the performed each year to ensure QM principles are applied in all aspects of the service delivery system. Such plan must support the Contractors compliance to the reporting requirements and performance standards and measures in Tempus contracts with state agenciesand be approved by EOHHS and must include, at minimum the essential functions.

Essential Functions
•   Developing, maintaining and updating written policies and procedures and ensuring internal controls are documented and in place for each task identified in the state contracts.
•   Applying and interpreting audit and compliance requirements for various departments
•   Ensuring that the agencys staff are trained as appropriate and follow the policies and procedures as written.
•   Design control systems to address cases of violation of internal business policies.
•   Designated as the Compliance and Privacy Officer.
•   Conducting internal reviews on a periodic basis to verify that staff are adhering to the policies and procedures and internal controls that are in place, including but not limited to:

•   Conducting a random sampling of the agencys financial and claims transactions, including but not limited to PCA payments, deductions, activity forms, and claims submission, to ensure compliance with all measures identified in Performance Standards 3, 4 and 5 of Appendix B of the FI Contracts.
•   Conducting a match of activity forms, claims, payroll registers and PA to ensure PCAs are being paid accurately and in a timely manner in accordance with Contract requirements, and that the appropriate dues and fees are withheld and paid in accordance with the collective bargaining agreement;
•   Reviewing Consumer records to ensure the records are complete and that current state and federal tax forms are being used;
•   Ensuring staff are reviewing state and federal tax authority on a regular basis and the Contractor is using current tax forms and is in compliance with state and federal tax laws;
•   Reviewing claims submissions to ensure claims reflect the services provided and are being submitted to EOHHS in accordance with Contract requirements;
•   Ensuring that the Contractor has not paid PCAs who are on the OIG LEIE; and
•   In cases of potential fraud, such as those cases where a PCA works for more than one Consumer, or where a PCA is earning more than $50,000 annually from his or her provision of PCA services, conduct a review of activity forms and report any suspicion of fraud to EOHHS.

•   Ensuring any suspicion of fraud is reported to EOHHS; and reporting on the outcomes of the work plan for quality assurance activities, in accordance with Appendix A.
•   Work with business units to understand new use cases and operational procedures for new business scenarios involving internal or external data handling.
•   Interacting with external auditors on matters related to audits of the organizations internal controls
•   Performs or oversees initial and periodic information privacy risk assessments/analysis, mitigation, and remediation. Ensures ongoing measurement and auditing on overall effectiveness of the privacy program and execution of privacy policies and standards, both internally and by third party vendors.
•   Reviewing and assessing potential fraud activity and developing fraud detection tools
•   Filing regulatory reports and other documentation
•   Coordinating rollout and training of new or updated policies and directives when required
•   Build on a strategic and comprehensive privacy program that defines, develops, maintains and implements policies and processes that enable consistent, effective privacy practices which minimize risk and enable employees and vendors to appropriately and responsibly handle personal data in compliance with applicable laws and regulations.
•   Collaborate with IT manager to ensure alignment between IT Security and privacy compliance programs and establishes, with IT security, an ongoing process to track, investigate and report inappropriate access and disclosure of protected personal information and protected health information. Competencies

•   Knowledge of payroll processing including withholding, filing and payment of federal and state income taxes and employment taxes, federal and state labor laws and state workers compensation insurance laws; federal and state tax, labor and workers compensation requirements for domestic service workers, household employers and Vendor Fiscal/Employer Agents preferred;
•   At least two years experience in developing and applying quality management principles; and
•   At least one year of experience in providing Vendor Fiscal/Employer Agent services to people with disabilities preferred.
•   Demonstrated ability delivering results and advancing privacy program maturity
•   Technical aptitude and understanding of IT systems and their connection to data collection and processing and privacy/security.
•   Collaborative Team Player Preferred Experience
•   3-5 years of experience in a professional setting, particularly in the realm of compliance. In-depth knowledge of industry standards, rules and regulations , management and accounting.
•   Ability to set priorities, work independently or in a team environment and will with multi task effectively.
•   Must be people oriented with sound judgment and the ability to be consistently diplomatic in stressful and complex situations.
•   Excellent communication and interpersonal skills with the ability to listen effectively, establish credibility and respond appropriately while relating to a diverse workforce.
•   Demonstrated excellence in managing finance, accounting, budgeting, payroll, control, and reporting.
•   Ability to manage supervisors in a multifaceted system.
•   Familiarity with office machines, equipment and software. Required Education
•   Bachelors Degree in b usiness management, legal studies, business administration, project management or a similar field of study .
•   Additional certifications in the field of compliance and administration a plus. Work Environment
