Job Description


Qualifications:



• At least 8 years of legal experience preferably including experience at a technology, fin-tech or financial services company



• Experience with ACH payments and NACHA rules is a plus



• A solid academic and training background, licensed to practice law in the United States



• Experience across a range of commercial and technology law issues & contracts and the ability to analyze and identify the core legal issues, skilled at explaining technical problems succinctly and clearly



• A working knowledge of data privacy and intellectual property issues and how they relate to technology



• A fast learner who can gain rapid familiarity with complex products, services and legal frameworks and maintain knowledge of those changing products, services and legal frameworks



• Solutions oriented with excellent time management, planning and organizational skills



• Able to work flexibly under pressure and with tight deadlines



• Strong drafting, writing, oral communication and negotiating skills, able to communicate your vision and roadmap effectively to a wide variety of stakeholders



• Exceptional interpersonal skills with proven experience in relationship building and partnering. Must work well in both team and individual settings



• Strong business acumen



• Language: Fluent English


Client is looking for an experienced product and payments attorney to provide temporary cover within the US open banking legal team. This role will include partnering closely with product teams to provide legal support and guidance on product development of open banking solutions in the payments space, advancing Client technology development and engagements, and supporting the growth of Client open banking business in the US.


The successful candidate will act as an advisor for product and sales clients to help enable the delivery of the commercial objectives and business strategy. This role requires commercial acumen, the ability to analyze product constructs and identify legal considerations, provide pragmatic and strategic guidance to the product teams and have great instinct for when to bring in subject matter experts such as regulatory, privacy and compliance counsel.


As part of the legal team, you will take a major role in handling product development and support matters for the business on a day-to-day basis, identifying and analyzing relevant issues and helping the business effectively navigate legal and regulatory risks and implement appropriate controls, policies and processes.


Job duties:



• Provide legal and business risk assessment and analysis on matters including new product constructs, sales agreements and go-to-market strategies related to Client open banking and payments solutions in the US.



• Advise from the concept through development to launch stage and beyond of various solutions and services.



• Work cross-functionally across product and legal teams (including data privacy, intellectual property, antitrust, regulatory, compliance, and franchise) to advise holistically on product constructs and commercial agreements to ensure that they are consistent with corporate strategy, internal policies and procedures and applicable laws and regulations.



• Collaborate with product, technology, sales, marketing, communications and others to develop and launch innovative products and solutions that differentiate Client and meet our customers' and cardholders' rapidly changing needs.



• Assist clients in managing and mitigating legal and commercial risks by providing solution-oriented guidance.



• Ensure alignment and compliance of products and services with Client policies, procedures and processes and with local laws and regulations.



• Work with internal and external regulatory counsel relating to the impact of local laws, government regulations and directives relating to Client US open banking and payments solutions.



• Cover a broad range of commercial and contractual matters, including product and marketing legal review, pilot agreements, and technology agreements with various partners in the payment's ecosystem, including fintechs, financial institutions, merchants, processors, and service providers.
