Our client is seeking a highly skilled and experienced Senior Living Defense Litigation Attorney to join our growing team. They are a reputable firm dedicated to providing exceptional legal representation to senior living facilities, including nursing homes, assisted living communities, and rehabilitation centers, in complex litigation matters. This role offers the opportunity to defend our clients against allegations of negligence, abuse, and wrongful death, ensuring their compliance with regulations and protecting their reputations.
Responsibilities:
Case Management: Independently manage a caseload of complex litigation matters involving claims of nursing home negligence, abuse, and wrongful death. This includes all phases of litigation from initial investigation and pleadings through discovery, mediation, trial, and appeal.
Legal Research and Analysis: Conduct thorough legal research and analysis to develop effective defense strategies and arguments. Stay abreast of evolving laws and regulations related to elder law, healthcare, and personal injury defense.
Discovery and Investigation: Conduct comprehensive investigations, including reviewing medical records, interviewing staff and witnesses, and retaining expert witnesses. Manage and oversee all aspects of discovery, including depositions, interrogatories, and requests for production.
Motion Practice and Court Appearances: Draft and argue complex motions, represent clients in court hearings, and conduct trials.
Settlement Negotiations: Effectively negotiate settlements with opposing counsel to minimize financial exposure and protect the client's reputation.
Client Communication: Maintain regular and effective communication with clients, providing updates on case progress, explaining legal strategies, and addressing their concerns with professionalism and responsiveness.
Risk Management Counseling: Advise clients on risk management strategies and best practices to prevent future litigation.
Collaboration: Collaborate with other attorneys and legal staff to develop and implement firm strategies and best practices.
Compliance: Ensure compliance with all relevant state and federal laws and ethical rules.
Expert Witness Management: Retain, prepare, and manage expert witnesses for depositions and trials.
Qualifications:
Juris Doctor (JD) degree from an accredited law school.
Active member in good standing of the Michigan bar.
Minimum of four years of experience in civil litigation.
Proven track record of successful trial experience and settlement negotiations.
Excellent legal research, writing, and oral advocacy skills.
Strong analytical and problem-solving abilities.
Exceptional organizational and time management skills.
Ability to work independently and as part of a team.
Experience with medical terminology and medical records analysis.
Experience retaining and working with medical expert witnesses.
Preferred Qualifications:
Experience defending against claims of medical malpractice within the context of nursing homes.
