An Assistant District Attorney (ADA) is responsible for representing the Commonwealth's position and interest when individuals are charged with committing a criminal act. Involvement in the cases assigned to the ADA begins with the initial stages of the investigation and continues through all stages of the investigation and prosecution, up to and including the sentencing and any post-sentence motions.

Essential Duties and Responsibilities

  • The Assistant District Attorney will act as a resource for law enforcement, other Assistant District Attorneys, Detectives and lawyers, and attend community outreach programs when asked by the District Attorney.
  • The Assistant District Attorney must advise police on matters of filing complaints when asked, attend write-ups, and secure additional information from law enforcement personnel when required.
  • The Assistant District Attorney must formulate trial strategy, determine sentence sought, conduct plea negotiations and research applicable case law.
  • The Assistant District Attorney must secure and interview witnesses to ascertain the facts of the case, secure expert testimony and prepare witnesses for trial.
  • The Assistant District Attorney must communicate information on case status to all involved parties such as defense attorneys, law enforcement and victims.
  • The Assistant District Attorney must provide training, legal instruction and research assistance to less experienced attorneys.
  • The Assistant District Attorney may be responsible for specific types of crime prosecution such as domestic disputes, narcotics, sexual assaults, major crimes, elder abuse and DUI.
  • Additional responsibilities are at the discretion of the District Attorney.
  • Part Time Employees are required to work a minimum of 1,000 hours per calendar year. All employees are required to maintain a record of their hours on forms supplied by the District Attorney's Office and these forms shall be submitted by the employee to the District Attorney on a monthly basis.

Minimum Qualifications

  • Include being in good standing and admitted to practice before the Bar of the Commonwealth of Pennsylvania.
  • No application will be accepted in instances where the applicant has any pending criminal charges filed against him/her, other than minor traffic violations, in this or any other jurisdiction. No applicant shall have any pending disciplinary complaints or proceedings brought against him/her by the Disciplinary Board of the Supreme County of Pennsylvania or the Disciplinary Board of any other jurisdiction. An applicant is obligated to disclose any prior criminal charges and convictions, other than minor traffic violations, as well as any disciplinary complaints and proceedings brought against him/her by the Disciplinary Board of the Supreme Court of Pennsylvania or the Disciplinary Board of any other jurisdiction.
  • Applicants must submit a resume, writing sample and list of three professional references.

I. Medical Insurance
The coverage begins for the employee the on the first of the month following the first full 30 days of full-time employment for employees and their eligible dependents. Cost to the employee to participate in the plan varies by the coverage selection and the number of dependents; and may be subject to collective bargaining agreement. The employee may also elect to opt out of the County's medical insurance if proof of coverage is provided. Under this arrangement, the employee is provided with an annual opt out payment.

II. Vision and Prescription
The coverage begins for the employee on the first of the month following the first full 30 days of full-time employment for employees and their eligible dependents. Contributions may vary, subject to collective bargaining agreement.

III. Dental Coverage
The coverage begins for the employee on the first of the month following the first full 30 days of full-time employment for employees and their eligible dependents. Contributions may vary, subject to collective bargaining agreement.

IV. Life Insurance
A $50,000 life insurance policy is afforded to full-time employees, unless specified differently in a collective bargaining agreement. It remains in effect as long as the employee is actively employed and terminates upon resignation or retirement.

V. Retirement
All full-time employees and part-time employees working more than 1,000 hours per year qualify for Luzerne County retirement benefits, in which employees must contribute 5% of their earnings, and may choose to add to an additional voluntary contribution, not to exceed an additional 10%.
